The central legislation governing gaming in India is the Public Gambling Act of 1867, which states that a game of mere skill is one where success depends mainly on the player’s knowledge, training, attention, experience, and adroitness, although chance cannot be entirely eliminated. Poker is considered a game of skill, requiring psychological skills, an understanding of statistics and probability, and strategizing skills. Bets are placed based on calculated odds and predictable outcomes, and the winner is determined by probability and preponderance.
However, the Indian Constitution permits states to enact laws regulating betting and gambling in their respective jurisdictions, and state legislation on gambling prevails over the Public Gambling Act of 1867. The Assam Game and Betting Act of 1970, the Odisha (Prevention of) Gambling Act of 1955, the Telangana State Gaming (Amendment), the Amendment to the Andhra Pradesh Gaming Act of 1974, and the Ordinance and High Court Judgment in Gujarat in 2017 prohibit games with money stakes and do not make an exception for games of skill. 5.3.3. All PokerBet (PokerMatch) bonuses and/or offers can only be used for playing and cannot be transferred or paid out without complying with the set requirements of the bonus promotion. The user must acknowledge and understand the existence of separate terms and conditions regarding promotions, bonuses, and special offers, which are additional to the General Terms and Conditions. These terms and conditions can be found on the relevant promo pages and/or in the marketing letters.
5.3.4. The receipt of bonuses at PokerBet (PokerMatch) Casino is subject to the activation/receipt rules for each specific bonus, which can be found in the description of the bonus promotion on the website inplay.pokermatch.com and/or the Additional Terms and Conditions subsection of each such description. For example, Welcome Bonuses.
5.3.5. Each bonus received by a player has an expiration date for activation, use, and wagering. When the bonus expires, the bonus balance will be reset.
5.3.6. To activate the deposit bonus, the user must enter the code in the “Bonus code” field of the “Cashier” section on the website. Please note that in order to activate the poker bonus, the user must log in to the game client at least once before depositing with the code.
5.3.7. If a player encounters difficulties while activating/using the free gift free spins (for example, received during a draw), such free spins are not subject to compensation or re-issue.
5.3.8. Requests for the re-issue or compensation of gift free spins for a deposit can only be considered after the expiration of the issued gift.
5.3.9. PokerBet (PokerMatch) Casino has a specific system for receiving and wagering bonuses that ensures fair play and proper usage of bonus funds. Here’s a breakdown of how it works:
- When a player receives a bonus, the bonus amount is added to their “Bonus Balance”, which is separate from their “Available funds”. This ensures that the bonus funds are kept separate from the player’s own funds and can only be used for the specific bonus offer.
- When the player makes a bet, the amount is deducted from their “Available funds”. If the player doesn’t have enough funds in their “Available funds”, the bet is then deducted from their “Bonus Balance”. This means that the bonus funds will only be used when the player’s own funds are insufficient.
- Any winnings obtained from playing with bonus funds are credited to the player’s “Bonus Balance”. However, these winnings cannot be withdrawn until the bonus wagering requirements have been met. Additionally, the bonus itself cannot be withdrawn until it has been fully wagered.
- Once the bonus wagering requirements have been met, the funds in the player’s “Bonus Balance” linked to the active bonus will be transferred to their “Available funds”. This means that the player can then withdraw these funds at any time.
5.3.10. When wagering a bonus, it is not allowed to solely use bonus funds and then complete the wagering with money bets once the bonus funds become available or are cancelled. This tactic is considered abusive and if detected, PokerBet (PokerMatch) Casino reserves the right to confiscate any winnings obtained through such means.
5.3.11. If a bonus is lost during wagering, it will remain active and the wagering will continue. To cancel a bonus manually, players must cancel it themselves.
5.3.12. All bonuses are wagered in the order they are received.
5.3.13. Wagering requirements cannot be met through bets with minimum risk on any games. This means that a player cannot place bets proportionally on different outcomes to create “action” with minimal risk (such as betting on both red and black in roulette).
5.3.14. Attempts to bypass the bonus wagering terms and conditions are considered fraudulent abuse of the bonus offer. PokerBet (PokerMatch) Casino reserves the right to take appropriate action, which may include the complete blocking of the player’s account and confiscation of funds.
5.3.15. The following games are eligible for bonus wagering: [list the eligible games]
5.3.16. It is not allowed to abuse postponement of any game rounds, including free spins, any accumulated bonuses, or bonus games when playing with bonus money. If any postponed games, bonuses (including any cumulative benefits), or free games are detected, the player’s account will be blocked, and they will be denied services with forfeiture of funds. When a gift offer is deleted or expires, any uncompleted accumulated bonus games and associated funds will also be considered part of the deleted bonus.
5.3.17. Players have the option to reset their bonus balance independently. However, doing so will result in the cancellation of all funds on the bonus balance, and these funds cannot be recovered. In the event of any fraudulent actions on the part of the player, PokerBet (PokerMatch) Casino reserves the right to reset the bonus balance of such players and refuse to grant bonuses in the future.
5.3.18. Players are allowed to request the withdrawal of the deposit amount made before fulfilling the bonus wagering conditions. However, in such cases, both the bonus and any winnings obtained while playing with the bonus funds will be deducted from the account. It’s important to note that when playing with an active bonus, real funds are used first, followed by the bonus funds.
5.3.19. If a player wins an amount that the casino management considers worthy of publicity while playing at the casino, the player agrees to participate in any such event organized by the casino. The player’s personal data is kept secure at the casino, and the company reserves the right to use the player’s nickname in the publications of the promo results on the website for promotional purposes.
5.3.20. PokerBet (PokerMatch) reserves the right to verify progressive jackpot winnings or any other casino winnings over 30,000 USD or the equivalent in any other currency before processing any payout request. Such winnings must be verified within 30 days.
5.3.21. If any winnings that do not belong to the user are mistakenly credited to their account due to a technical or human error, this amount remains the property of PokerBet (PokerMatch). In the event of such incorrect crediting, the user must immediately notify PokerBet (PokerMatch) via e-mail at [email protected].
5.3.22. PokerBet (PokerMatch) intends all bonus campaigns and promotions to be recreational and has the right to limit a player’s eligibility to participate in any promotion at its sole discretion. The casino reserves the right to modify, cancel, renew, or reject any promotion at any time without prior notice.
5.3.23. PokerBet (PokerMatch) has the right to limit the issuance of bonus offers without providing any reason or prior notice. If a player is not eligible for a bonus, the casino will notify the player through email or website notification.
5.3.24. PokerBet (PokerMatch) has the right to modify or terminate any bonus or promotion at any time without prior notice. If there are any changes to a bonus or promotion, the casino will inform players via email or website notification.
5.3.25. If a poker account remains inactive (i.e., no successful login in the poker client) for 90 days, the balance of the player’s Points will be automatically reset to 0.01. This process is irreversible, so it is recommended that players remain active and use their Points within 90 days to exchange them for real money or participate in tournaments. If the Points are not used within 180 days from the last successful login, they will be forfeited.
5.3.26. Players cannot withdraw their deposit if they received a bonus with a wager until they have met the wagering requirements or cancelled the bonus.
5.3.27. Bonus balances below ₹4 are automatically reset.
5.4.1. In.pokermatch.com has the right to cancel poker games, tournaments, and promotional events.
